Ford Pro Privacy Notice

1. Information About Our Organization, Website, and Services

This Privacy Notice (“Notice”) explains the Personal Information collected, used, and shared by Ford Motor Company and its affiliates and subsidiaries, including Ford Pro™ (“Ford Pro™”) (collectively, “Ford,” “we”, “us,” or “our”) through fordpro.com (the “Website”), as well as through the comprehensive charging solutions and services associated with planning (including professional design), deploying (including build and installation), insuring and performing insurance-related services, and operating (including software and account management, hardware, warranty, training, success management, and preventative maintenance services) vehicle fleets by Ford Pro™ (the “Services”).

This Notice applies to the Website and Services described above. This Notice does not apply to data processed by Ford Pro™ in connection with services Ford Pro™ provides as a service provider to a fleet owner customer.

Please read this Notice carefully before using the Website and Services. By using the Website and the Services or otherwise providing Personal Information to us, users consent to our data collection, use, and disclosure practices. This Notice should be read in association with our Website Terms and Conditions, which govern the Website, and our Fleet Terms and Conditions, which govern the Services. If you do not agree, please discontinue use of the Website and Services.

2. Information We Collect From Users

“Personal Information” is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with individuals. Personal Information does not include information that is publicly available, de-identified, or aggregated. We collect Personal Information through various means, including when it is provided directly to us and automatically through the use of the Website and Services.

Information Users Provide

The Personal Information we may collect directly includes: names, home addresses, personal email addresses, organization/business names and contact information, and GPS data to determine where Services and requests should be fulfilled (for example, to locate vehicle chargers). When you communicate with us, such as via email, customer service request, survey response, or website chat, we collect the content of your communication.

Information We Collect from Business Partners

We may obtain Personal Information from other sources, including our agents, vendors, consultants, affiliates, and other service providers, as well as other companies within the Ford family of companies or subsidiaries (“Affiliated Companies”). Our “family of companies” is the group of companies related to us by common control or ownership.

In some circumstances, we obtain Personal Information from third parties, some of whom may sell the information to us. We may combine this information with information we collect through other means described above. This helps us to update and improve our records, identify new customers, create more personalized advertising, and suggest services that may be of interest. To understand the rights and choices regarding Personal Information collected by other businesses, please consult the privacy policies of those businesses.

Information Collected Automatically

We automatically collect certain information about individuals when they access or use the Website or Services (“Usage Information”). Usage Information may include IP addresses; device identifiers; browser types; operating systems; information about individuals’ uses of the Website and Services; data regarding network-connected hardware (e.g., computers or mobile devices); domain names of websites that allowed users to navigate to the Website or use the Services; search engines used; the length of time spent on the Website; the pages viewed on the Website; the URL of the websites visited before and after visiting the Website; the frequency of visits to the Website; and certain other available information. Usage Information collected as part of the Services may also include vehicle identification number (VIN), date/time, ignition status, vehicle location, acceleration, engine-related information, diagnostic data, fuel or electronic charge usage, and software and hardware version numbers. The Usage Information collected varies based on the equipment installed in the vehicle.

The methods we use to collect Usage Information include:

  • Log Files. Log information is data about an individual’s use of the Website or the Services, such as IP address, browser type, Internet service provider, referring/exit pages, operating system, date/time stamps, and related data, which may be collected and stored in log files.
  • Tracking Technologies. We use cookies, web beacons, embedded scripts, and other tracking technologies to collect and store information about users’ interactions with the Website and certain Services, including information about browsing behavior. The Website also supports third-party cookies placed by our vendors, consultants, affiliates, and other service providers.

    In general, the Website uses cookies and other tracking technologies as follows:
    • Where necessary to run the Website.
    • To optimize the functionality of the Website, including by remembering visitor preferences (e.g., choice of language or region).
    • For analytics purposes, for example, to help us understand how the Website is used or navigated, as well as to count the number of visitors, content views, and advertising views.
    • For advertising and marketing purposes.
    • To determine if a user opens or acts upon our email messages. Information on unsubscribing from our commercial email communications is provided below.
    • To obtain information about user interactions with our online advertisements, such as whether a user clicked on an ad and the website where the user may have seen the ad.

Cookies vary in how long they last. “Session cookies” terminate shortly after a user terminates an internet session. “Persistent cookies” are stored on a device until a set expiration date. We use both session and persistent cookies on our Website.

  • Location-identifying Technologies. We use GPS (global positioning system) software, geo-filtering, original equipment manufacturer ("OEM") telematics embedded hardware and cloud platform software for data collection and data management, and other location-aware technologies to locate users (sometimes precisely), or make assumptions about user locations, for purposes such as verifying a user location and delivering the Services described above. If a user or fleet owner customer has enabled GPS or other location-based features through the Services, the device location may be tracked by us and third parties.
  • Device and Activity Monitoring. We use technologies that monitor, and may record, certain user interactions with the Website or Services, and/or collect and analyze information from vehicles and user devices, such as, without limitation, the operating system, plug-ins, system fonts, and other data, for purposes such as identification, security, fraud prevention, troubleshooting, tracking and/or improving the Website and customizing or optimizing user experience on the Website.
  • Chat Features. Where Ford Pro makes chat features available, we may use vendors to provide the chat feature and share chat-related information with those vendors, such as Salesforce. Our vendors that support chat features only use chat communications to support and improve the Ford chat experience.
3. User Choices About Tracking and Communications From Us

Cookies and Tracking Technologies

Cookies may generally be disabled or removed by tools available as part of most commercial browsers, and in some instances blocked in the future by selecting certain settings. Browsers offer different functionalities and options, so a user may need to set them separately. Users should review their browser’s help menu for instructions, or visit www.allaboutcookies.org for more information. Please note that if all cookies are disabled, some features of the Website or Services may not function properly.

Do Not Track Signals

Browser settings may allow users to automatically transmit a “Do Not Track” signal to online services visited. Note, however, there is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, our services are not designed to respond to “Do Not Track” signals received from browsers. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls described below.

Users may choose not to receive some interest-based advertising by submitting opt-outs. Some of the advertisers and service providers that perform advertising-related services for us may participate in the Digital Advertising Alliance’s (“DAA”) Self-Regulatory Program for Online Behavioral Advertising and/or the Network Advertising Initiative (“NAI”). Please be aware that opting out only means that those selected members should no longer deliver certain interest-based advertising but does not mean a user will no longer receive any targeted content and/or ads (e.g., from other ad networks).

Email Communications

A user may unsubscribe from our marketing email communications by clicking the “unsubscribe” link found in every marketing email we send. If a user opts-out of our marketing email communications, we may still send email messages related to the user’s account, the Services, or purchases with us. Unsubscribing from our marketing communications will not affect the level or quality of service we provide.

4. How We Use the Information We Collect

The information users provide on the Website or through the Services may be used to:

  • Provide the Services (e.g., fleet leasing services, fleet management services, fleet administration services, insurance services, telematics services), including to process transactions, provide customer support, and operate, maintain, and improve the Website and Services;
  • Communicate with users, including responding to user comments, website chats, questions, and requests, providing customer support, and sending users updates and administrative messages (if an opt-out is available, users will find that option within the communication itself or in the account settings) including the use of automated-processing in support of such communication;
  • Compile user data, including with data about users that we collect through other sources and may be used for marketing and other purposes where legally allowed;
  • Develop new products, services, and marketing;
  • Provide location-based customer assistance;
  • Process vehicle upgrade transactions; and
  • Comply with legal requirements.

User information may also be used for research and development. We use information about how users interact with the Website and Services to troubleshoot, to identify trends, usage, activity patterns, and to improve features and technologies that benefit our users.

5. How We Share the Information We Collect

We may disclose user Personal Information for any purposes consistent with this Notice, our written statements at the point of collection, or as permitted under applicable law. In general, we may disclose Personal Information that we collect about users with other companies within the Affiliated Companies. We disclose Personal Information within the Affiliated Companies as a normal part of conducting business and offering products and services to our customers.

We may disclose information with our agents, vendors, consultants, and other service providers in order for them to provide their services to us. For example, we may share user Personal Information to provide customer service; operate and improve our business, the Website, and our Services; improve our products and customer service; perform auditing and quality control; communicate with users, including through automated processing; and otherwise operate our business. Agents, vendors, consultants, and other service providers who have access to user Personal Information in connection with providing Services are required to keep the information confidential and are restricted in their use of the data. We may disclose information with engineering, procurement, construction, or maintenance (“EPCM”) service providers designated by Ford Pro™ under contract to perform installation or other Services at our users’ designated locations on behalf of Ford Pro™.

We may also disclose users’ Personal Information as necessary, for the following purposes: (a) to comply with any legal process; (b) to respond to requests from public and government authorities; (c) to enforce our terms and conditions located at https://www.fordpro.com/en-us/termsAndConditions; (d) to protect our operations and protect our rights, privacy, safety, or property, and/or that of users or others; (e) to allow us to pursue available remedies or limit the damages that we may sustain; (f) in communication with our insurers and professional advisers for the purposes of managing risks, obtaining professional advice, and exercising or defending against legal claims; and (g) in communication with third parties in connection with or during negotiations of any reorganization, acquisition, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceeding).

The business information, including user business contact information, that is provided to the Website or through the Services may be shared with authorized dealers where necessary, including honoring a request for a price quote on a vehicle or to provide a dealer with information for contacting users in connection with users’ businesses. Each dealership operation is a separate legal entity, independent from Ford and its Affiliated Companies. As such, each dealership has its own privacy practices and Ford and its Affiliated Companies are not responsible for these privacy practices.

6. Security

We take commercially reasonable measures to protect Personal Information from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. Nevertheless, transmission via the Internet and electronic storage are not completely secure, and we cannot guarantee the security of any user’s Personal Information.

Agents, vendors, consultants, and other service providers of Ford Pro™ who have access to user Personal Information in connection with providing the Services or the operation of the Website are required to maintain the confidentiality of users’ Personal Information and are not permitted to process users’ Personal Information for any other purpose than to carry out the services they are performing for the Website or Services.

7. Links

The Website may contain links to other websites, and other websites may link to the Website. Please be aware that we are not responsible for the privacy practices of other websites. Whenever a user visits another website―via a link from the Website or otherwise―the user should review the Notice of that other website. This Notice applies solely to information provided or obtained through the Website or Services.

8. Age Restrictions

The Website and Services are not intended for use by children under the age of sixteen (16) and we do not knowingly collect, maintain, or use Personal Information from children under sixteen (16) years of age. If a user is under the age of sixteen (16), that user may not use our Website or the Services. If a parent, guardian, or other individual believes that a child under the age of sixteen (16) has provided us with Personal Information, please contact us using the methods set forth below.

9. International Users

This Notice only applies to Personal Information collected about individuals in the United States. If the Website or Services are accessed from outside of the United States, please be aware that Personal Information collected through the Website or Services may be transferred to, processed, stored, and used in the United States. Users located in another country should review the Ford Pro™ Notice that applies for that country.

10. California Privacy Notice

CALIFORNIA PRIVACY NOTICE FOR INDIVIDUALS IN A BUSINESS OR COMMERCIAL RELATIONSHIP WITH FORD PRO™

This California Privacy Notice (the “CA Notice”) supplements the main Notice and provides additional details on how Ford Motor Company and its affiliates and subsidiaries, including Ford Pro™ (collectively, “Ford”, “our,” “we,” or “us”) collects, uses, and discloses the Personal Information of California residents who interact with Ford Pro as an employee, owner, director, officer, or independent contractor of another company, partnership, sole proprietorship, or government agency (each an “Entity” and collectively “Entities”). This Notice also explains your rights relating to Personal Information under the California Consumer Privacy Act, as amended (the “CCPA”). We use the word “you” or “your” to refer to anyone within the scope of this CA Notice. In the event of a conflict between any other Ford policy, statement, or notice and this CA Notice, this CA Notice will prevail as to California residents’ rights under the CCPA. Captalized terms in this CA Notice have the same meaning as the terms defined in the CCPA or our main Notice.

This CA Notice applies to Personal Information we Collect about you when you interact with Ford Pro™ or manage one of our products or Services as the representative of an Entity that is a Ford Pro™ customer. This CA Notice does not apply to data processed by Ford Pro™ in connection with Services Ford Pro™ provides as a Service Provider to a fleet owner customer.

Unless otherwise noted, the Information Practices below describe our current practices and our practices for the twelve (12) months preceding the Effective Date.

We do not Collect Sensitive Personal Information for the purpose of inferring characteristics about you. We do not use or disclose Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the CCPA.

Sources of Personal Information

We collect the Personal Information identified above from the following sources (whether we collected it from a specific source depends on the nature of your interaction with us):

  • Directly from you. We collect Personal Information from you when you provide it to us, such as in connection with a transaction, while interacting with our Website, when you call us or our call center, or while providing information in response to a survey. As indicated above, Ford Pro™ may also utilize global positioning system (“GPS”) software, geo-filtering, original equipment manufacturer (“OEM”) telematics embedded hardware and cloud platform software for data collection and data management, and other location-aware technologies to locate users (sometimes precisely), for purposes such as verifying a user location and delivering services. If a user or fleet owner customer has enabled GPS or other location-based features through the Services, the device location may be tracked by us and third parties.
  • Automatically when using our digital services or visiting our premises. We collect Personal Information about you when you use our information technology services, including our websites. Please see our general Ford Pro™ Privacy Notice, above, for additional details.
  • Created by us. We collect Personal Information about you that we create, such as credentials for access to our information technology systems, or inferences generated from other information we collect.
  • Service Providers. We collect Personal Information about you from certain Service Providers that provide information to help us run our business.
  • Affiliates. We share Personal Information among the companies within the Ford Motor Company family of companies and affiliates. We receive information within this “family,” as permitted, to enable us to manage our business and workforce.
  • Law enforcement agencies, courts, regulatory agencies, and other government agencies. We may receive information from government agencies to comply with the law, to protect your personal safety or the safety of others, to protect our or others’ rights, or to investigate fraud.
  • Other parties. We may receive information about you from other parties when necessary to manage or operate our business. For example, in litigation settlements we may collect information about you from third parties related to our operational or tax reporting obligations.
  • Parties to corporate transactions. As permitted by law, we may receive Personal Information as part of a corporate transaction or proceeding, such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of a business or assets.

Disclosures of Personal Information

This section describes the categories of Personal Information Sold to Third Parties or Shared with Third Parties for Cross-Context Behavioral Advertising in the preceding twelve (12) months. We offer you the ability to opt-out of these disclosures as set forth in the “Right to Opt Out of Sales and Sharing of Personal Information” Section below or by visiting our Your Privacy Choices page.

We may Sell and/or Share with Third Parties for Cross-Context Behavioral Advertising the following categories of Personal Information:

  • Identifiers
  • Internet or other electronic network activity information
  • Geolocation data

We Sell and/or Share this Personal Information for advertising purposes to Third Parties. The Third Parties to whom this Personal information was Sold and/or Shared are advertisers and analytics vendors.

We do not knowingly Sell the Personal Information of minors under sixteen (16) years of age.

We also disclose the Personal Information described in this CA Notice to Service Providers that help us run our Business. We also may disclose the Personal Information described in this CA Notice in other circumstances when required to or permitted by law. These circumstances include:

  • disclosures among the companies within the Ford Motor Company family of companies and affiliates, when permitted by law;
  • disclosures to other parties to provide products or services requested by you;
  • disclosures to parties when required or permitted by law to defend against legal claims;
  • to law enforcement agencies, courts, regulatory agencies, and others when the disclosure is required or permitted by law, including to comply with valid legal process; and
  • to parties in a corporate transaction or proceeding, such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of our business or assets.

How Long We Keep Your Personal Information

We keep the categories of Personal Information described above for as long as is necessary for the purposes described in this Notice or otherwise authorized by law.

This generally means holding the information for as long as one of the following criteria apply:

  • your Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;
  • your Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was Collected;
  • the Personal Information is reasonably required to protect or defend our rights or property (which will generally relate to applicable laws that limit actions in a particular case); or
  • we are otherwise required or permitted to keep your Personal Information by applicable laws or regulations.

Where Personal Information is used for more than one purpose, we may retain it until the purpose with the latest period expires. For more information about our retention policies, please contact us using the contact details below.

Submitting Requests Relating to Your Personal Information

If you have an account with Ford Pro™, you may manage your account, including accessing, deleting, or correcting certain Personal Information we have about you, by accessing your Ford Pro™ account at fordpro.com.

If you are a resident of California, you also have the right to submit certain requests relating to your Personal Information as described below. To exercise any of these rights with respect to the information covered in this Notice, please submit a request through our webform or by calling us at 1-888-459-1291. Please note that, if you submit a request to know, request to delete, or request to correct, you will be asked to provide two-to-three pieces of Personal Information that we will match against our records to verify your identity. You may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed. An authorized agent may submit a request on your behalf using the webform or toll-free number listed above.

Right to Know. You have the right to know what Personal Information we have Collected about you, which includes:

  • The categories of Personal Information we have Collected about you, including (a) the categories of sources from which the Personal Information was Collected; (b) our Business or Commercial Purposes for Collecting Personal Information; (c) the categories of Third Parties to whom we disclose Personal Information; (d) the categories of Personal Information that we Sold or Shared, and for each category identified, the categories of third parties to whom we Sold or Shared that particular category of Personal Information; and (e) the categories of Personal Information that we disclosed for a Business Purpose and the categories of Third Parties to whom we disclosed each category of Personal Information.
  • The specific pieces of Personal Information we have Collected about you.

Right to Delete Your Personal Information. You have the right to request that we delete Personal Information we Collected from you, subject to certain exceptions.

Right to Correct Inaccurate Information. If you believe that Personal Information we maintain about you is inaccurate, you have the right to request that we correct that information.

Right to Opt Out of Sales and Sharing of Personal Information. You have the right to opt out of the Sale of your Personal Information, and to request that we do not Share your Personal Information for Cross-Context Behavioral Advertising. You may opt out of Sales or Sharing via cookie or tracking technologies, by clicking on the “Cookie Settings” link in the footer of our websites and interacting with our cookie preference center. We have also enabled the Global Privacy Control, which is designed to recognize opt-out preference signals. In order to process your request through an opt-out preference signal, you must use a browser or extension supporting the preference signal. If you choose to use an opt-out preference signal, you will need to turn it on for each browser and each device you use. If you would like to opt out of Sales and Sharing other than through cookies or other online tracking technologies, you can do so by filling out the request form here.

Right to Non-Discrimination for the Exercise of Your Privacy Rights. If you choose to exercise any of your privacy rights under the CCPA, you also have the right not to receive discriminatory treatment by us.

11. Notification of Changes to Privacy Policy

We will update this Notice when necessary to reflect changes in applicable law, our Products, what Personal Information we collect, or how we use Personal Information. When we post changes to the Notice, we will change the “Effective date” at the top of the Notice.
